Huawei and Qualcomm Sign a $6.9 Billion 5G Patent Deal Then Qualcomm Denies It Pays Huawei What Non US Founders Must Know in 2026
Let me tell you the real story behind the biggest tech business news of October 2026.
On Monday 5th October 2026, Huawei and Qualcomm announced a multi year patent deal. By Tuesday, every tech website was shouting that Qualcomm, the American giant behind Snapdragon chips, will now pay Huawei for its technology.
Then Qualcomm added one line at the bottom of its own announcement that changed everything.
The terms are confidential, but reports characterizing Qualcomm as a net payor on the license agreement are incorrect. And claims that the deal is related to LogicFolding are not accurate.
So who is paying whom? And why does this matter for you if you are a non US founder building a global brand from Bangladesh, Indonesia, Vietnam, Pakistan, Nigeria or anywhere in the world.
What The Deal Actually Is
This is not a simple payment. This is a cross licence.
A cross licence means both companies allow each other to use their patents. In this case the licence covers 5G, computing, AI and networking.
In a cross licence, nothing is free. Both sides calculate whose patents are worth more. The company that comes out behind pays the difference. That company is called the net payer. Qualcomm is saying it is not the net payer on this licence agreement.
But there is a second part to the deal that most people missed.
Qualcomm is also buying some of Huawei US patents in computing, AI and networking. These are non cellular patents, so they are not about mobile networks. In this second transaction, Qualcomm is the buyer and Huawei is the seller. Qualcomm said nothing about who pays in this part.
So both stories can be true at the same time. Huawei may not get net payment on the licence, but it will get paid for the US patents it sells. Whether Huawei ends up ahead when you add both together is hidden in the confidential terms.
Why This Story Went Viral
For the last 25 years, money went only one way. Huawei says it made its first licence payment to Qualcomm in 2001 and only started earning licence income of its own in 2011 from Motorola.
According to Qualcomm annual report for 2025 financial year, their last deal with Huawei had expired from early 2025. So for more than a year, Huawei had no licence agreement with Qualcomm at all.
Huawei says this is its first deal with Qualcomm to cover 5G and with this deal the total value of Huawei patent licensing agreements has crossed USD 6.9 billion.
In China, media called it the first time Huawei comes out ahead on income against Qualcomm.
And then there is LogicFolding. This is Huawei secret weapon. In May 2026, Huawei presented LogicFolding as a way to make chips faster without needing ever smaller transistors. Normally a chip circuits are flat. LogicFolding stacks them in layers so signals travel shorter distances. This matters because US trade restrictions since 2019 block Huawei from buying advanced chips. The Kirin 9050 Pro is the first chip built this way and it went into the Mate XT 2 tri fold last month. Reports on Monday said Qualcomm would licence LogicFolding and pay Huawei for the first time. Qualcomm says that is not accurate.
What It Means For Phones and For Your Business
For anyone buying a phone, nothing changes. This deal covers patents only. Qualcomm still cannot sell Huawei Snapdragon chips because the US Commerce Department revoked its export licence in May 2024. Huawei Mate 90 series will keep running its own Kirin chips.
But for non US founders, this is a big business lesson.
Huawei is cut off from American chips since 2019. Still it built a patent portfolio worth 6.9 billion dollars. Now even Qualcomm has to buy its non cellular US patents.
If you are building products in Bangladesh, Indonesia, Vietnam, Pakistan or anywhere, do not just sell the product. Protect the idea behind it. File patents in the US through your Wyoming LLC. One day your patents can become your biggest asset.
